SPITwSPOTS provides broadband Internet access services primarily to residential and business subscribers. The following statement reviews our network management practices and the performance and commercial terms of our broadband Internet access service. (“Broadband Service”)[1] This statement is provided to all 1) customers to make informed choices regarding their use of our services and for content, application, service and to all 2) device providers to develop, market and maintain Internet offerings.
We use a variety of technologies to deliver Broadband Service to customers, but our primary network technology is fixed wireless. Based on consumer speed data, a user’s expected and actual access speed and latency will vary based on network conditions, congestion, other users on the network, the number of devices attached to an access point and other factors. The expected access speed and latency, based on internal testing, is on an “up to” basis for speeds as advertised, and latency is not predicted to exceed 100 ms at least 95% of the time. Our service is designed to provide customers with Broadband Service with actual and expected download speeds as follows:

Actual access speed and latency can vary due to the nature of fixed wireless network architecture, and customers can test their actual speed at any time using any commercially available testing services.
Maximum broadband speeds can be limited by certain factors. For example, performance may be affected by your computer configuration, network or Internet congestion, customer location, Wi-Fi connectivity, the number of users on the network, the quality of premises wiring, proximity to an access point, the lack of clear line-of-sight to network access points or by seasonal changes such as foliage or other weather conditions. Under normal circumstances, our service is suitable for real-time applications.
We offer end users Non-Broadband Internet Access Service Data Services such as managed routers. Such services may affect the amount of last-mile capacity available for and the performance of broadband Internet access service by using up bandwidth.
Broadband Service is provided subject to our Terms and Conditions, which list our prices and fees for early termination or additional network services.
Providing quality Broadband Service requires that we take steps to provide reasonable management of our network.
To manage congestion and promote security on our fixed wireless networks, we block access to apps that are known to be malicious based on industry standard metrics, and we also prohibit the use of peer-to-peer file sharing services on our networks. We also rely on dynamic traffic shaping mechanisms to make more efficient use of available bandwidth and to improve the quality of the customer experience, particularly for applications that require additional bandwidth such as Voice Over Internet Protocol, gaming or streaming video. Our traffic shaping and prioritization techniques do not benefit affiliates or edge providers, but rather to optimize service and to promote efficient usage. Moreover, some of our customers pay more for dedicated Internet access services that may have higher priority on our networks in cases of congestion. In cases of security concerns, we may need to limit traffic to or from particular points or otherwise take appropriate action. The purposes for these network management are to optimize network capacity, to facilitate delivery, to monitor and prevent spam, viruses and malicious content, to handle congestion and to promote quality of service.
We have in place congestion management practices designed to reduce or eliminate congestion on our networks. Multiple users share upstream and downstream bandwidth on our networks, and we apply congestion management techniques when users place a disproportionate demand on this bandwidth and on the capabilities of our network, thus potentially degrading the experience of other users. Typically on our networks these practices occur infrequently based on disproportionate consumption of network resources. In many cases, the end user’s experience is unaffected, although in some instances customers may experience longer times to download/upload files, slower response during web surfing, and/or lags in playing games online. If a usage pattern is excessive, we ask that the user either upgrade their service or reduce their pattern usage. If the user chooses neither of these options, SPITwSPOTS reserves the right to terminate the user’s service and/or account.
We sometimes address application-specific behavior in our network practices. For example, we block and rate control the following protocols or protocol ports for the purpose of protecting the user experience. To address hacking issues, we block most incoming connections on protocol ports that constitute common attack vectors (ports 22, 23, 80, 443) to public access on Residential and Business customer routers. We also block outbound port 25 (except to known good mail servers), all peer-to-peer file sharing programs and known malicious software. Some DSCP codes may be modified from time to time so that they will work correctly with our wireless hardware or for delinquent accounts. We have no restrictions on the types of devices that may attach to our network or any approval procedures for devices to connect to our network; however, customers are required to comply with our acceptable use policy.
We take seriously our commitment to security of our network and of service to end users. To advance this goal, we engage in practices used to facilitate such security, such as adopting security obligations for our customers as part of our Terms and Conditions.

Our advertised speeds are not guaranteed for the reasons described in this statement, but they are projections based on normal operating conditions.
Our company’s privacy practices are described here. Our service to a limited extent involves the inspection of network traffic for purposes of troubleshooting and optimizing bandwidth usage. We do not store such traffic, provide it to third parties or use it for purposes other than reasonable network management.
