SPITwSPOTS — PRIVACY POLICY

This privacy policy applies to the websites controlled by SPITwSPOTS, Inc. and/or its subsidiary and affiliated entities ("SPITwSPOTS," "we" or "us") where this privacy policy is posted (collectively, the "Sites"). For SPITwSPOTS customers, this Privacy Policy is incorporated by reference into our Service Agreement. For non-customer visitors to SPITwSPOTS’s website, this privacy policy governs the collection and use of personal information of website visitors.

BY USING THE SITES, YOU CONSENT TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND TO OUR PROCESSING OF PERSONAL INFORMATION FOR THE PURPOSES STATED BELOW. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE SITES.

Information that SPITwSPOTS May Collect and Maintain

We may collect and maintain the following personal information regarding you, your use of our Services and/or your use of the Sites:

Your email address, first and last name, zip code, logins, passwords, and other identifying or online contact information;
Your social security number;
Your driver’s license number;
Your gender;
Billing records, which may include credit card or bank information;
Records that are necessary to provide the Services to you;
Correspondence and content uploads that you send to us;
Call detail records, and records of customer support or technical support communications related to the Services and any equipment that we provide for use of the Services;
Persistent identifiers that can be used to recognize a user over time and across different websites or online services;
Records of IP addresses that may be assigned to equipment that is connected to the Services on your account;
Geolocation information sufficient to identify street names and the names of a city or town;
Records used in network management, including records of your use of bandwidth for the Services.

In addition, certain types of usage information is collected whenever you interact with the Services or with the Sites. We automatically receive and record information from our server logs from your browser, including your IP address, cookie information and the pages you request. We also record details of your activity on the Sites and the Services, including site visits. We may also collect aggregate statistical data for use in optimizing the online experience.

Use of Information Collected and Maintained

We may use information collected about you, your use of the Services and/or your use of the Sites:

To deliver the Services;
To collect services fees and other charges owned in connection with the Services;
To provide customer or technical support;
To customize the Services and the sites to your browsing experience and preferences;
To alert you to special offers, updated information and other new products and services;
To complete a transaction or service requested by you;
To ensure that our websites are relevant to your needs;
To help us create and publish content most relevant to you;
To notify you about a material change to our terms and conditions;
To allow you access to limited-entry areas of the Sites; and
To contact you in response to sign up forms such as Contact Us.

To the extent that information collected constitutes customer information, SPITwSPOTS will not intentionally disclose such information to third parties except in the following circumstances:

You provide your prior consent.
To the extent necessary for SPITwSPOTS to conduct its business, such as providing Services to you, billing, maintenance or other service calls, to alert you to special offers or new products, network management, collection of unpaid fees and charges.
To respond to orders related to any legal process, such as orders from courts or administrative agencies, or to exercise legal rights or defend against legal claims, or to respond to valid subpoenas or warrants.
To investigate, prevent or take action regarding illegal activities such as fraud, physical threats to any person, violation of any agreements with SPITwSPOTS or as otherwise or permitted by law.
To third-party professional advisers, such as accountants or attorneys who do work for SPITwSPOTS.

In certain instances, SPITwSPOTS is prohibited by law from informing customers about the disclosure of personally identifiable information pursuant to legal processes. In other instances, subscriber notification may be required due to a court order or other legal requirements. Except in cases where notification to customers is required by law, SPITwSPOTS will determine on a case-by-case basis whether customer notification is warranted.

This privacy policy governs only that information that SPITwSPOTS collects as a result of providing Services to you or as a result of your visits to the Sites. We do not control the privacy policies of other service providers or websites, and these third parties may collect and use information in a manner that is at variance from this privacy policy. You acknowledge and agree that you are responsible for reading, understanding and accepting the privacy policies of other products, services or websites.

Mobile Information Privacy

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third party.

Public Posting Area

Please note that any information you include in a post to any chat room, forum or other public posting area is available to anyone with Internet access. If you don't want people to know your personally identifiable information, for example, don't include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION IN CHAT ROOMS, FORUMS AND OTHER PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION THAT YOU DISCLOSE IN CHAT ROOMS, FORUMS AND OTHER PUBLIC POSTING AREAS.

Retention

SPITwSPOTS will retain customer information for as long as the customer relationship is in effect and thereafter for such period as may be necessary to conduct SPITwSPOTS’s business or as otherwise required or permitted by law.

Compliance with the Children’s Online Privacy Protection Act

The Sites are general audience websites that comply with the Children’s Online Privacy Protection Act. This Federal law applies to operators of commercial websites and online services directed to children under 13 that collect, use or disclose personal information from children, and it applies to operators of commercial websites that have actual knowledge that they are collecting, using or disclosing personal information from children under 13. COPPA also requires website operators who collect personal information from children under the age of 13 to get prior parental consent. SPITwSPOTS does not knowingly collect, and does not wish to collect, personal identifiable information from children under the age of 13.

Security and Privacy

Because Internet transmissions cannot be guaranteed to be 100% secure, consistent with our Acceptable Use Policy, we cannot ensure or warrant the security of any information that you transmit using the Services or the Sites. By using our services, you acknowledge that any such information is transmitted, stored or retrieved at your own risk. You can help protect against unauthorized access to your account and to your personal information by employing appropriate password protections, firewalls and other common methods to enhance end-user security. You also agree to take reasonable precautions to protect the privacy and security of your accounts, networks and transmissions.
